LIABILITY RELEASE

In consideration for my attendance and participation with Empower Martial Arts, I, the student/parent, acknowledge the existence of certain inherent risks of injury in this type of training and hereby agree to assume all risks.  I also hereby state that the students named above are physically fit to take the prescribed course of instruction and do so at their own free will.  I further agree to release and hold harmless EMPOWER MARTIAL ARTS and any individual, officer, employee, agent or representative of EMPOWER MARTIAL ARTS, against any and all claims, actions, demands, liabilities, and damages with respect to any illness or injury, or any loss or damage to property of any type, relating to or arising out of participation in the EMPOWER MARTIAL ARTS activity.

MEDICAL RELEASE

I authorize EMPOWER MARTIAL ARTS’s staff or employees participating in this activity to obtain on the participants’ behalf, any first aid or medical services, which may be considered necessary or advisable in the event of illness or injury. I further acknowledge and agree that I will be responsible for any medical costs that may be incurred as a result of such illness or injury and resulting medical treatment.

PHOTO / VIDEO PERMISSION

I authorize that photos or video may be taken at the activity that may include participant, and I hereby grant permission to EMPOWER MARTIAL ARTS to use such photos / videos for promotional materials.

CANCELLATION

Members must submit the membership termination form AT LEAST SEVEN DAYS PRIOR TO YOUR NEXT PAYMENT DATE to officially terminate membership. Once you submit the termination request, you agree to completely terminate your membership and forfeit any rights and entitlements to the current tuition rate. You acknowledge that this form must be submitted at least 7 days before your next payment date. If your account is charged, you will not be prorated any amount.

NO REFUND POLICY
Empower Martial Arts has a strict no refund policy. Your membership is a MONTHLY MEMBERSHIP. Members understand that their obligation to pay all fees, including tuition, is unconditional and that no portion of the fees paid will be prorated and/or refunded in the event of the member’s absence, withdrawal, or dismissal from classes.

COVID-19

Empower Martial Arts is aware of the spread and impact of the novel coronavirus, COVID-19, and has taken our best precautions to prevent the spread and transmission of this disease amongst our members. However, Empower Martial Arts cannot guarantee the member, or the children or family of the member, will not contract or be infected with COVID-19 through participation in Empower Martial Arts’ programs. Participation in Empower Martial Arts’ program may increase your risk of infection by exposure to others. Empower Martial Arts will use its best efforts to comply with all federal, state and local regulations to reduce the risk of infection and exposure.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I and/or my child(ren) may be exposed to or infected by COVID-19 by participating in programming at Empower Martial Arts, and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 through participation or attendance at Empower Martial Arts may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Empower Martial Arts employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my or my child(ren)’s attendance and participation in programs at Empower Martial Arts. On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless Empower Martial Arts, its employees, agents, and representatives, of and from any claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to my or my child(ren)’s participation and attendance of any Empower Martial Arts program. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Empower Martial Arts, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Empower Martial Arts program.
